PROFESSIONAL TAX APPEALS, LLC SERVICE AGREEMENT
TERMS AND CONDITIONS
Professional Tax Appeals, LLC, to be referred to as PTA in this document
A) FEE: For successful property tax reduction services rendered, I agree to pay Professional Tax Appeals, LLC, to be referred to as PTA in this document, a contingency fee of 40% of the estimated tax savings calculated in Item B) below for any appeal tax year. Although tax reduction is not guaranteed, I understand that I will owe NO money unless PTA reduces my taxes and saves me money. Professional Tax Appeals, LLC will use its best efforts and expertise to lower your taxes. Furthermore, it is acknowledged that PTA has made no representations or warranties regarding the outcome of your protest.
B) CALCULATION OF FEES: The estimated tax savings shall be calculated as follows: Subtract the newly appraised value, agreed upon by PTA and the Appraisal District, from the initial assessed value and then multiply the difference by the previous year total tax rate; that number is the estimated tax savings used to calculate your contingency fee to be paid only if Professional Tax Appeals, LLC is successful with your protest. If Professional Tax Appeals, LLC does not prevail at the Appraisal Review Board and believes that they can be successful in the appeal process, I authorize Professional Tax Appeals, LLC to purse binding arbitration or to engage counsel for the judicial appeal process; PTA is responsible for all expenses including court costs, appraisal, expert witness fees, and all legal fees. I understand that I will pay nothing unless the protest / appeal process is successful, I agree to pay a contingency fee of 40% of the estimated tax savings, which results from the successful arbitration or judicial appeal.
The following methodology is a hypothetical example of how our fee will be calculated based on your tax savings after a successful protest.
1. Initial Tax Liability Before Protest
Appraised / Assessed value of your property before your protest - $500,000.
Tax Rate Utilized by the County (Harris County) - 1.771% per $100 of property value.
$500,000 / $100 = $5,000 X 1.771 (Tax Rate) = $8,855 Taxes owed for your property taxes before your protest
2. Tax Liability After a Successful Protest / Appeal
Appraised / Assessed value of your property after a successful protest - $400,000.
Tax Rate Utilized by the County (Harris) – 1.771% per $100 of property value.
$400,000 / $100 = $4,000 x 1.771 (Tax Rate) = $7,084 Taxes owed for your property after a successful protest.
3. Calculation of Contingency Fee
$8,855 - $7,084 = $1,771 (Tax Savings)
$1,771 x 40% = $708.40 Fee owed for a successful protest / appeal.
C) PAYMENT: Once the appeal process is completed, either by ARB hearing, arbitration, or judicial litigation, I agree to pay a 40% contingency fee, which is 40% of the tax reduction as outlined in Item B) above. Terms shall be 30 days after the invoice date and if unpaid after that time I agree to pay interest on any unpaid balance at a rate equal to the lesser of the maximum lawful interest rate allowed under Texas law or 12% per annum compounded annually.
D) SENIORS AND ACTIVE MILITARY and Exemptions: In consideration of special circumstances, PTA offers a lesser contingency fee is 25% for validated senior citizens 65 or older, disability, and active military personnel. Exemptions can reduce the taxable value for your property and lower your tax burden. Some notable exemptions can include Homestead, Disability, Homeowner over 65 years old, and Veteran status.
E) DURATION OF AGREEMENT: This agreement supersedes all previous agreements between PTA and me. This agreement will remain effective, and PTA will continue to appeal my property taxes annually, until cancellation of the agreement is requested by either party with a 30-day written notice.

G) LIABILITY: I understand a tax reduction is not guaranteed, and I will own no money unless my taxes are reduced. The liability of PTA for any errors, omissions, actions, inactions, statements, or representations is limited to the amount of fees paid under this contract for the years in dispute. If any litigation arises from this agreement, I agree to the venue (choice of law) to be Harris County, Texas.
